1. Scope of the Privacy Policy<\/strong><\/h2>\n

1.1 This Privacy Policy sets out the rules of personal data processing on the website operating under the domain name serpentarius.hu (hereinafter referred to as the \"Website\") of Serpentarius Software Kft. (registered office: 1042 Budapest \u00c1rp\u00e1d \u00fat 89 1\/5, company registration number: 01-09-278537, tax number: 24375625-2-41) by the Data Controller (hereinafter referred to as the \"Data Controller\") during the use of the services provided by the User. By using the services provided on the website through active, active behaviour, the User acknowledges that he\/she is bound by this Privacy Policy. The User reads and accepts this Privacy Policy prior to any contact.<\/p>\n

1.2 This Policy is in compliance with Regulation 2016\/679 of the European Parliament and of the Council (\u201eGeneral Data Protection Regulation\u201d or \u201eGDPR\u201d), Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information (\u201eInfotv.\u201d), Act V of 2013 on the Civil Code (\u201eCivil Code\u201d) and Act 2008. Act XLVIII of 2001 on certain aspects of electronic commerce services and information society services (\u201eGrtv.\u201d), Act CVIII of 2001 on certain aspects of electronic commerce services and information society services, and Act C of 2000 on accounting (regarding the issue and retention of supporting documents). It is necessary to specify that, while respecting the general principles, the records (data) and documents to be kept for the period of time specified by the sectoral legislation may, where appropriate and necessary, contain personal data, the retention of which for the period of time specified by the legislation must not infringe the rights of individuals.<\/p>\n

1.3 The Data Controller reserves the right to amend the Privacy Policy. The Data Protection Policy may be amended only within the framework of the provisions of data protection legislation and in accordance with the content thereof. The amended Privacy Policy shall be published by the Data Controller on its website in the same manner as before. The amendment shall enter into force on the day following its publication. In the event of any amendment, the provisions of point 1.1 shall apply.<\/p>\n

1.4 Definitions <\/strong><\/p>\n

1.4.1\u00a0 Data file<\/em><\/strong>: the set of data managed in one register<\/p>\n

1.4.2\u00a0 Data management<\/em><\/strong>: any operation or set of operations which is performed on Personal Data, regardless of the procedure used, in particular the collection, recording, organisation, structuring, storage, adaptation, alteration, use, consultation, consultation, use, disclosure, transmission, dissemination or otherwise making available, disclosure, alignment or combination, restriction, erasure and destruction of Personal Data.<\/p>\n

1.4.6 Service(s): <\/em><\/strong>the services provided by the Data Controller to Users as customers, which the Data Controller performs as available services and in the course of which it performs data processing.<\/p>\n

1.4.7 User<\/em><\/strong>: a natural person who uses any of the Data Controller's Services or contacts the Data Controller for the purpose of possibly using a Service and, in this context, provides at least one of the personal data listed in point 1.5.<\/p>\n

1.4.8 Website<\/em><\/strong>: website operated by the Data Controller: serpentarius.hu<\/p>\n

1.4.9 Data file<\/em><\/strong>: the set of data managed in one register<\/p>\n

1.4.10 Data destruction<\/em><\/strong>: the complete physical destruction of the medium containing the data;<\/p>\n

1.4.11. Data transmission<\/em><\/strong>: if the data is made available to a specified third party;<\/p>\n

1.4.12 Disclosure to the public<\/em><\/strong>: if the data is made available to anyone;<\/p>\n

1.4.13 Data deletion<\/em><\/strong>: rendering data unrecognisable in such a way that it cannot be recovered;<\/p>\n

1.5 Scope of personal data processed <\/strong><\/p>\n

1.5.1 The Data Controller may process personal data in connection with the use of the Services and in the case of entering into a contract.<\/p>\n

1.5.2 If the User sends an e-mail or calls the e-mail address or telephone number indicated on the serpentarius.hu website in order to use a Service, the Data Controller records the User's e-mail address and\/or telephone number and processes it to the extent and for the duration necessary for the provision of the Service.<\/p>\n

1.6 The Data Controller <\/strong>additional data processed by the <\/strong><\/p>\n

The Data Controller may send a specialised data package (so-called \u201ecookie\u201d) on the User's computer in order to provide a personalised service. By using cookies, the Data Controller may process the following Personal Data: demographic data, as well as interests, habits, preferences based on browsing history, based on parameters provided by the User. The purpose of using cookies is to ensure the best possible functioning of the site, to provide personalised services and to enhance the user experience. The User can delete the cookie from his\/her computer or set and configure his\/her device to automatically disable the use of cookies. By disabling the use of cookies, the User also acknowledges that without cookies, the operation of the site may be incomplete and the use of certain services may be limited or hindered.<\/p>\n

2. Purpose and scope of data processing<\/strong><\/h2>\n
    \n
  • With regard to the processing of the User's personal data in the course of the services provided by the Data Controller, the Data Controller is the Data Controller who does not use a data processor for the processing. The Data Controller shall carry out the processing using its own technical means. The purpose of the processing is to maintain contact with the customer and to conclude contracts.<\/li>\n
  • In the case of processing based on consent, processing is always based on the User's voluntary, informed and unbiased consent, solely for the purposes set out in this Privacy Policy, to the extent and for the duration strictly necessary to achieve those purposes, in a manner appropriate for achieving those purposes and in accordance with the provisions of data protection legislation.<\/li>\n
  • If the User contacts the Data Controller via the e-mail address or telephone number found on the Data Controller's website, the Data Controller shall record the User's e-mail address and\/or telephone number and process it to the extent and for the duration necessary for the provision of the service. By contacting the User, the Data Controller shall consider the consent to the processing of the User's personal data as given.<\/li>\n
  • The legal basis for the processing of personal data when entering into a contract with the Data Controller is that the processing is necessary for the performance of a contract to which the data subject is a party or is necessary for taking steps at the request of the data subject prior to entering into the contract.<\/li>\n
  • The purpose of the processing:<\/li>\n<\/ul>\n

    The Data Controller uses the data to provide Services or to comply with legal obligations, in particular for the following purposes:<\/p>\n

      \n
    • communication, the primary purpose of which is to provide Users with appropriate information and to respond to messages sent by Users;<\/li>\n
    • the obligation to file tax returns and keep supporting documents.<\/li>\n<\/ul>\n

      The Data Controller shall keep the personal data for the time strictly necessary for the purpose for which they were collected and for as long as required by law. The data shall be deleted at the request of the user or after the non-existence, termination and performance of the contract, if the processing of the data is no longer necessary for the enforcement of the claim arising from the contract or if the Controller has voluntarily waived the purpose of the processing.<\/p>\n

      • The Data Controller does not process any data beyond the data related to the use of the Service provided by it. If it processes other data for the purposes of increasing the efficiency of its service, sending electronic advertisements or other targeted content to the user, market research and statistics, it will process them only after informing the User and with his\/her explicit consent, provided that the purpose of the processing is specified in advance.<\/li>\n
      • The personal data processed by the Data Controller is processed by the Data Controller for the purposes arising from the function of the given service for the duration of the provision of the service.<\/li>\n<\/ul>\n

        3. Data transmission<\/strong><\/h2>\n
          \n
        • The Controller may transfer personal data processed by the Controller to third parties only with the prior consent of the User and with prior information about the purpose of the transfer.<\/li>\n
        • Data processing <\/strong><\/li>\n<\/ul>\n

          The Data Controller uses the Data Processors designated in these Rules to carry out its activities. The Processors do not take independent decisions and are only entitled to act in accordance with the contract concluded with the Controller and the instructions received. The Data Controller shall monitor the activities of the Processors and the protection of personal data on an ongoing basis. The Processors may use other processors or subcontractors only with the consent of the Controller.<\/p>\n

          4. Data security<\/strong><\/h2>\n
            \n
          • The Data Controller shall make every effort to prevent and prevent unauthorised persons from obtaining knowledge of or accessing the personal data it processes. To ensure this, the Controller shall use technical and IT tools and solutions that comply with industry standards and shall take appropriate measures. In doing so, the Data Controller shall take particular account of the fact that the services provided on the Website may be accessed via an open access Internet network, which requires enhanced security measures.<\/li>\n<\/ul>\n

            • Although the Data Controller takes all reasonable measures to ensure the security of the data, in view of the rapid development and changes in infocommunication technology and the fact that the risks arising from the characteristics of information technology cannot be completely excluded in advance, it is possible that a third party may access, access, intercept or otherwise misuse personal data processed by the Data Controller by unlawful means, despite the security measures applied by the Data Controller, in a manner unknown to the Data Controller. The Data Controller shall not be liable for any damage resulting from such unlawful activities and for any misuse of personal data thus obtained by a third party.<\/li>\n<\/ul>\n

              5. Duration of data processing by the Data Controller<\/strong><\/h2>\n
                \n
              • If no contract is concluded between the Data Controller and the User following the contact, the Data Controller shall process the personal data until the date of the failure of the contract.<\/li>\n
              • If a contract is concluded between the Data Controller and the User following the contact, the Data Controller shall process the data for as long as a claim may be asserted in connection with the contract (based on the general limitation period under the Civil Code) or for as long as it is legally obliged to do so.<\/li>\n
              • If the deletion of personal data is ordered by a court or a competent authority by a final decision, the Data Controller shall carry it out within the shortest possible time after receipt of the decision. Otherwise, the Controller shall not erase Personal Data until such time as the purpose of the processing or the legal obligation which precluded the erasure of the Personal Data has been fulfilled.<\/li>\n<\/ul>\n

                6. Data subjects' rights in relation to data processing<\/strong><\/h2>\n
                  \n
                • The User has the right to know at any time which personal data are processed by the Data Controller for which purposes and which personal data have been transferred by the Data Controller to which third parties for which purposes. The User may request the rectification or erasure of his\/her personal data in accordance with this Privacy Policy. The User may make the request for information by sending an e-mail to the electronic mailbox kapcsolat@serpentarius.hu.<\/li>\n
                • The Data Controller shall consider a request for information sent by letter to be justified if the request can be used to identify the applicant unequivocally and unambiguously. The Data Controller reserves the right to ask the applicant, in case of doubt, for other identifiable information before executing the request for information.<\/li>\n
                • The request for information may cover the data of the applicant processed by the Data Controller, the source of the data, the legal basis, purposes and duration of the processing, the names and addresses of any data processors, the activities related to the processing and, where personal data have been transferred, the persons who have received or are receiving the data and the purposes for which they are receiving or are receiving them.<\/li>\n
                • The Data Controller shall provide the information in writing in an intelligible form within the shortest possible period of time, but not later than 25 days from the date of the User's request for information.<\/li>\n
                • The User may request the rectification, correction or modification of his\/her personal data processed by the Data Controller. Taking into account the purpose of the processing, the User may request the completion of incomplete personal data. Once the request for amendment of personal data has been fulfilled, the previous data cannot be restored.<\/li>\n
                • The User may request the erasure of his\/her Personal Data processed by the Data Controller. <\/em>Deletion may be refused on the basis of a legal authorisation for the exercise of the right to freedom of expression and information. In all cases, the Data Controller shall inform the User of the refusal of a request for erasure, indicating the reason for the refusal. Once the request for erasure of personal data has been complied with, the previous data cannot be restored. Letters sent by the Data Controller may be cancelled through the unsubscribe link contained therein. In case of unsubscription, the Controller will delete the User's personal data in the newsletter database. Newsletter subscription is not available on the current website.<\/li>\n
                • The User may also request the Controller to restrict the processing of his\/her personal data if the User contests the accuracy of the personal data processed. In this case, the restriction shall apply for the period of time necessary to allow the Controller to verify the accuracy of the Personal Data. The Controller shall mark the Personal Data it processes if the User contests its accuracy or correctness but the incorrectness or inaccuracy of the contested Personal Data cannot be clearly established. The User may request that the Controller restrict the processing of his or her personal data even if the processing is unlawful, but the User opposes the erasure of the processed personal data and instead requests the restriction of their use.<\/li>\n
                • The User may request that the Data Controller provide the Personal Data provided by the User and processed by the User in an automated way to the Data Controller in a structured, commonly used, machine-readable format and\/or transfer them to another data controller.<\/li>\n
                • The User may object to the processing of their Personal Data. The Data Controller shall examine the lawfulness of the User's objection and, if the objection is justified, shall terminate the processing and block the Personal Data processed, and shall notify the objection and the action taken on the basis thereof to all those to whom the Personal Data concerned by the objection have been previously disclosed.<\/li>\n
                • The information provided for in point 6.1 is free of charge if the person requesting the information has not yet submitted a request for information to the Data Controller in the current year for the same area. In other cases, a fee may be charged. The fee already paid shall be refunded if the data have been unlawfully processed or if the request for information has led to a correction.<\/li>\n
                • In addition to the above information, the Data Controller shall ensure that the User is informed at any time before and during the use of the service about the types of data processed by the Data Controller for which purposes.<\/li>\n
                • The User may directly contact the National Authority for Data Protection and Freedom of Information (address: 1125 Budapest, Szil\u00e1gyi Erzs\u00e9bet fasor 22\/c.; phone: +36-1-391-1400; e-mail: ugyfelszolgalat@naih.hu; website: www.naih.hu) with any complaint regarding data processing.<\/li>\n
                • In case of violation of the User's rights, he\/she may take legal action. The court of law shall have jurisdiction to hear and determine the action for non-pecuniary sanctions and the district court shall have jurisdiction to hear and determine the action for damages and for claims based solely on pecuniary rights arising from the infringement of personal rights. Upon request, the Data Controller shall inform the User of the possibilities and means of legal remedy.<\/li>\n
                • For matters not covered by this Privacy Policy, the provisions of Regulation 2016\/679 of the European Parliament and of the Council (\u201eGeneral Data Protection Regulation\u201d or \u201eGDPR\u201d) and Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information (\u201eAct on the Freedom of Information\u201d) shall apply.<\/li>\n<\/ul>\n
